Brett H. Ludwig Named U.S. Bankruptcy Court Judge

ludwigPrior to appointment to the bench, Brett H. Ludwig was a partner with Foley & Lardner, where he was vice chair of the firm’s Insurance & Reinsurance Litigation Practice. He was also a member of the Insurance Industry Team. Before joining Foley, Ludwig was a law clerk to the Hon. George G. Fagg, Circuit Judge, United States Court of Appeals for the Eighth Circuit.

Ludwig’s practice focused on reinsurance counseling and dispute resolution. He has represented both ceding companies and reinsurers in numerous disputes over reinsurance receivables. He has arbitrated cases involving disputes over treaty wording interpretation, alleged placement misrepresentations, and alleged breaches of utmost good faith. Ludwig has substantial experience in obtaining pre-hearing security for outstanding incurred losses. He has also enforced arbitration provisions in reinsurance treaties against reluctant reinsurers, compelling them to arbitrate under the Federal Arbitration Act.

Ludwig also had a substantial practice in general insurance matters. He has represented insurers in federal courts across the country.

Ludwig received his J.D. degree, magna cum laude, from the University of Minnesota in 1994. He served as a managing editor of the Minnesota Law Review and was elected to the Order of Coif. He received his bachelor’s degree, with highest honors, from the University of Wisconsin – Stevens Point in 1991.

Ludwig was named to the 2006 and 2007 lists of Wisconsin Super Lawyers – Rising Stars by Law & Politics Media, Inc. for his business litigation work.
