Nevada Supreme Court Shakes Things Up

As if being home to Sin City isn’t exciting enough, Nevada recently decided to shake things up! In a rather surprising 4-3 decision, the Nevada Supreme Court in SFR Investments Pool 1, LLC v. U.S. Bank National Association, et al. held:

  1. That the superpriority portion of an HOA lien enjoys true superpriority status under NRS 116.3116(2) so as to extinguish the first deed of trust upon foreclosure; &
