Often, consumer decisions influence or impact judicial opinions in business cases. Courts may choose to adopt the application and reasoning of a consumer decision in total, may analyze the court’s holding and reject it in the context of a Chapter 11 case, or may apply the holding in a business case without addressing the merits of whether the consumer case holding should apply in Chapter 11.
