Discussing the required elements for tenancy by entirety, Missouri law established a presumption that a brokerage account was held in tenancy by entirety, and the trustee did not rebut that presumption. In re Haines, 528 B.R. 912 (Bankr. W.D. Mo. 2015).

These cases are of specific interest to creditors but debtor attorneys and trustees also should be aware. Chapter 7 debtor bears the burden of proof of demonstrating eligibility in order to convert to Chapter 13; such proof requires them to demonstrate that they have regular income adequate to fund a Chapter 13 plan. It is appropriate to convert a Chapter 13 case to one under Chapter 7 when the debtor makes no attempt to cure defaults that arise in the case or take any steps to propose a feasible plan.
