Interesting Take from Peenesh Shah

Peenesh Shah, law clerk to Judge Raymond T. Lyons, argues that Dewsnup v. Timm, 507 U.S. 410 (1992) compels the conclusion that wholly unsecured liens may not be stripped in so-called Chapter 20 cases. L.J. 161 (2011).  Shah attempts to show that Dewsnup’s rationale, statutory construction principles and the desirability of consistent interpretation of statutory terms of art mandate the conclusion that lien stripping is not available to Chapter 20 debtors.
